Terms of Service
Last updated: 2026-10-17
These terms govern your use of HeyMarketer (the "Service"), operated by Area2 (HK) Limited ("we", "us"). By using the Service you accept these terms. Contact: [email protected].
1. The Service and eligibility
The Service includes AI-assisted marketing research, content generation/editing, media and version management, connected Facebook/Instagram publishing and performance, email marketing, and API/MCP or agent access where enabled under your plan. Feature availability depends on your plan, configuration and third-party permissions.
You must be at least 18 and able to form a binding contract. If acting for an organisation, you confirm authority to bind it. Keep account credentials and agent connections secure and provide accurate account and billing details.
2. Your content and permissions
You retain the rights you have in your input content. You must own or have permission to use uploaded documents, images, logos, videos and any real person's likeness, and to manage every connected social account and email audience. Confirming a portrait-use checkbox does not obtain permission from the person for you.
You authorise us and our providers to host, copy, process and transmit your content as reasonably necessary to provide the features you request, preserve versions, publish/send to your selected targets and secure the Service. This permission does not transfer ownership of your input to us.
AI output can contain errors, resemble other output or lack copyright protection. We do not promise exclusivity, factual accuracy, clearance of third-party rights or marketing results. Review text, images, likenesses and claims before use; your use remains subject to applicable law and relevant provider/platform terms.
3. Publishing, Autopilot and agents
Immediate or scheduled publishing follows a content preview and confirmation. Autopilot runs according to the settings you explicitly enable and can pause; it can create and publish/send content without a separate manual review of every run where you enable that mode. You remain responsible for your settings, audiences and published content.
Your API keys, OAuth connections and agents operate within the permissions, limits and approval settings you grant. Review those settings and revoke access you no longer trust. An agent requiring Dashboard approval cannot grant its own approval; disabling that requirement permits eligible actions to proceed without a separate Dashboard approval.
Pausing or disconnecting stops eligible future work; it cannot recall posts or emails already accepted by a platform/provider. Some work already in progress may need reconciliation. Posts already published on Meta are not removed merely by disconnecting.
4. Acceptable use
No spam, phishing, impersonation, unlawful or misleading content, unauthorised access, evasion of permission/rate/quota limits, or infringement of privacy, intellectual property or likeness rights. Comply with the rules of connected platforms, including Meta's Platform Terms and Community Standards, and applicable advertising and AI-disclosure requirements. Where supported by our integration, we submit AI-content disclosure information; this does not replace your own disclosure obligations.
5. Plans, payment and renewal
The plan, currency, price, billing interval and quotas shown in your order, checkout or agreed account arrangement apply. An annual price expressed as a monthly equivalent is charged as the stated annual total; monthly Credit allocations are still issued by usage period. Taxes or other charges apply as disclosed at purchase.
Where Stripe online subscriptions are available, payment is handled through Stripe and subscriptions renew for the selected billing interval unless cancelled before renewal. You authorise the recurring charges you accept at checkout. A manual or separately agreed account follows its stated payment arrangement; a price displayed on the product site does not by itself create an active subscription.
New accounts require confirmed payment where applicable and completion of the activation/claim process. Failed or overdue payment may restrict paid features. Changes to published prices do not rewrite completed transactions or the entitlement snapshot already granted for a period; applicable renewal changes will be communicated as required.
6. Credits and quotas
AI tools use the Credit prices shown in the Service. Credits may be reserved before work starts, charged for delivered/billable outcomes and released for undelivered portions on completion or failure. Partial delivery may incur the charge for results actually delivered; retrying or requesting new work can use additional Credits. Quotas are separate from Credit balances.
Subscription Credits expire at the end of their usage period and do not roll over. Annual subscriptions receive monthly usage allocations, not all annual Credits at once. Purchased top-up Credits have the validity shown at purchase (normally 365 days) and are used in expiry order. Credits are service units, have no cash value and cannot be redeemed for cash except where required by law or an applicable refund decision.
7. Cancellation, plan changes and refund requests
For supported online subscriptions, cancel through Dashboard subscription management or contact [email protected]. Cancellation normally stops renewal and takes effect at the end of the paid billing term; confirm the effective date displayed for your subscription. Cancelling is separate from deleting your account or content.
Supported upgrades can take effect immediately with the displayed prorated charge and Credit adjustment. Downgrades normally take effect next billing term. Available interval changes and their effective dates are shown in the Service; an annual-to-monthly change may require waiting until the annual term ends. Review the confirmation before changing your plan.
For a refund request or a duplicate/incorrect charge, contact [email protected] with your registered email and the relevant order or invoice reference. We review the request against the terms agreed for that purchase and applicable law, and explain the outcome. Cancelling renewal does not itself submit or decide a refund request. Nothing in these terms limits a refund or remedy required by law. Do not send full card details.
8. Email marketing
Use verified senders, truthful identity/footer information and permission-based audiences. Purchased, rented or scraped lists, spam, phishing, impersonation and deceptive content are prohibited. Preserve unsubscribe facilities and respect suppression. We may pause delivery or restrict accounts to protect recipients and shared reputation. Provider acceptance is not a guarantee of delivery. AI-generated emails and automated checks do not replace your responsibility for consent and content. The Email Acceptable Use Policy forms part of these terms.
9. Availability and suspension
The Service depends on third parties including Meta, AI providers, DataForSEO, Stripe, AWS and Cloudflare. We do not guarantee uninterrupted availability, successful delivery or that third-party content remains published. Features can be restricted for abuse, security, non-payment, permissions or compliance. Restoring an account does not automatically resume paused sends or Autopilots. Contact us to resolve a restriction; legal and payment rights remain subject to applicable law.
10. Privacy, deletion and ending use
Our Privacy Policy explains processing, providers, retention and your rights. Disconnecting Meta, unsubscribing a recipient, cancelling payment and deleting a HeyMarketer account are distinct actions. Follow the Data Deletion Instructions for the appropriate scope. If access ends, retention and removal follow that policy and applicable legal obligations; provider cleanup or unresolved sends can delay final deletion.
11. Liability and governing law
The Service is provided as is, without warranties to the extent permitted by law. To that extent, we exclude liability for indirect or consequential losses, lost profits and losses caused by third-party actions such as token revocation, permission changes or moderation. Nothing excludes liability or rights that applicable law does not allow to be excluded.
Hong Kong SAR law governs these terms, with Hong Kong courts having exclusive jurisdiction except where applicable mandatory law provides otherwise.
12. Changes and language
We may update these terms and identify the revision by its date. Material changes will be notified through the Service or an appropriate contact channel as required by law. Continued use after the applicable effective date signifies acceptance, subject to any mandatory notice or consent requirements. English and Traditional Chinese versions are provided; the English version prevails where wording differs, to the extent permitted by law.
